Franklin Mutual Insurance Group (including members the Franklin Mutual Insurance Company, FMI Insurance Company, POM Insurance Company) as well as any subsidiaries, officers, directors, and employees ("FMI", "we", "our", or "us") offer online services such as our website, online accounts, and social media pages ("Services"). Use of these Services is governed by these Terms of Service. You should read these Terms of Service carefully. Through your use of the Services, either directly or through an agent or representative, you agree to these terms. If you do not agree with these terms, you should not use our Services. Failure to comply with any of these Terms of Service may result in your account being canceled and/or further legal action or prosecution. 

Product Descriptions 

Our Services provide general information only, such as summaries of the products and services we offer.  Actual coverage is subject to the terms, conditions and exclusions stated in the policies.  Coverage may be subject to certain limitations or modifications. Please consult the actual policy forms for complete details on coverages, conditions and exclusions. You should not rely on the summary representations provided on the Services. Price and availability is subject to change and products may not be available in all jurisdictions. 

Content Ownership 

Unless otherwise specified, FMI owns all content provided on the Services. Unauthorized use is prohibited and any use of any protected material is subject to applicable copyright and intellectual property laws. You may capture/print copies of materials for your personal use. Otherwise no content on the Services should be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed, in whole or in part or by any form or means, without prior written permission from FMI. Use of content for fraudulent or deceptive purposes is prohibited. Any information or ideas you provide (aside from personal information which is governed by our Privacy Notice) will be treated as FMI property and may be used without further permission, credit, or compensation to you - including ideas for product development and marketing. 

Acceptable Use 

Services are provided for your convenience. Use and access to restricted areas (such as online portals) is limited to authorized users only. FMI may monitor attempts to access restricted areas and may report suspicious activity to appropriate law enforcement or regulators. 

You agree to provide accurate and current information in connection with any use of our Services. Failure to do so or failure to comply with any of these Terms of Service may result in your account being canceled and/or further legal action or prosecution. You are prohibited from sharing content which is unlawful, harassing, vulgar, obscene, pornographic, indecent, or violates the rights of others. You are also prohibited from posting or transmitting any computer viruses or other malicious code. You agree to notify FMI if you discover or suspect that your account has been hacked or its security breached. 

You confirm that you are the rightful owner or an authorized user of any bank account or payment card you submit. By providing this information, you give the financial institution that issued the account or card permission to process any payments or withdrawals you authorize. 

Monitoring and Storing Information 

FMI may monitor any information which passes through, is transmitted, or accessed via our Services. You consent to such monitoring. 

You authorize FMI and our approved vendors, to store the information you provide. This may include your name, address, date of birth, driver’s license number, Social Security number, vehicle identification number (VIN), and any bank account or payment card details.

Use of our Services is at your own risk. Services are not and should not be considered insurance advice. 

TO THE EXTENT ALLOWED BY APPLICABLE LAW, FMI WILL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES, UNDER ANY LEGAL THEORY, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY, INCIDENTAL AND CONSEQUENTIAL DAMAGES AS A RESULT OF OR IN CONNECTION WITH YOUR USE OF THESE SERVICES, INABILITY TO USE THESE SERVICES, RELIANCE ON THESE SERVICES OR RELIANCE ON INFORMATION, RESOURCES, PRODUCTS OR SERVICES WITHIN THE SERVICES, OR IN CONNECTION WITH ANY ALLEGED ERROR, FAILURE, OMISSION, INTERRUPTION, DEFECT OR DELAY IN USE OF THE SERVICES INCLUDING AS A RESULT OF COMPUTER VIRUSES OR OTHER CYBERSECURITY ATTACK, EVEN IF FMI WAS MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT SUCH DAMAGES ARE AWARDED, YOU AGREE THE MAXIMUM LIABILITY FOR FMI WILL NOT BE GREATER THAN THE AMOUNT YOU PAID IN THE PAST 12 MONTHS TO ACCESS THESE SERVICES. 

SERVICES ARE PROVIDED IN AS-IS CONDITION WITH ALL FAULTS. FMI MAKES NO WARRANTY OF THEIR QUALITY, ACCURACY, OR AVAILABILITY. FMI DOES NOT REPRESENT THE SERVICES, THAT ARE PROVIDED, ARE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED, OR THAT THEY ARE FREE FROM COMPUTER VIRUSES OR OTHER HARMFUL CODE; OR THAT SERVICES WILL MEET YOUR NEEDS AND/OR EXPECTATIONS. FMI DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR ANY PURPOSE, OR NON-INFRINGEMENT. 

 Communications with You 

Text and Mobile Telephone Communications: By providing us with your email address, you consent to our use of that email address as the primary method to communicate with you related to your application, policy, billing, any claims, endorsements, or other communications as well as other promotions, services, special offers or other reasons. By providing us with your mobile telephone number you consent to receive text (SMS) and voice messages to that number, including pre-recorded messages and messages sent through the use of an automatic dialer.  Text (SMS) message frequency will vary based on your selected services or subscriptions. Message and data rates may apply. You are not required to consent to text (SMS) messaging as a condition of purchase. You may opt out of messages to your mobile telephone number at any time by texting “Stop” or calling FMI customer care at (800) 336-3642 or POM customer care at (888) 451-1804 . 

You can change your texting preferences or your email preferences at any time by: logging into "My Account," emailing FMI at billing@fmiweb.com, emailing POM at customercare@gopom.com or calling customer care at (800) 336-3642 or POM customer care at (888) 451-1804.  If have a Pennsylvania policy with us, you may request a paper copy of your policy or endorsement, or any changes to them at no charge by emailing POM customercare@gopom.com or calling POM customer care at (888) 451-1804. You agree to keep your email address and cell phone number up to date by logging into "My Account" or calling FMI customer care at (800) 336-3642 or POM customer care at (888) 451-1804. 

Consent to Receive Electronic Communications: BY AGREEING TO THE TERMS HEREIN, YOU ARE SPECIFICALLY AGREEING TO RECEIVE COMMUNICATIONS AND DOCUMENTATION ELECTRONICALLY AND NOT ON PAPER.  YOU ARE ALSO AGREEING TO EXECUTE DOCUMENTS, AGREEMENTS AND CONTRACTS ELECTRONICALLY, USING AN ELECTRONIC SIGNATURE, AND TO FORGO UTILIZING A PEN-AND-INK SIGNATURE ON A PAPER DOCUMENT.  

1. Your Legal Rights: 

Certain laws and regulations may require us to provide specific information, notices, disclosures, or other documents in writing, meaning you have a right to receive certain information on a printed paper document, if you so choose.  However, by agreeing to electronic communications, you hereby agree that FMI may lawfully provide such information to you electronically, and not on a paper document.  You agree that as applicable you will execute documents that we send to you electronically via electronic means, such as with an electronic signature.

At times, we may, at our option and sole discretion, still send you paper communications and documentation, but by providing FMI with your email address you explicitly agree that: (i) you are willing to receive Communications (defined below) and documentation only by electronic means that we may otherwise be required to provide on paper; (ii) you will execute electronic documents via electronic means, such as an electronic signature; and (iii) you have the hardware, software, and technological expertise needed to access Communications and documents via electronic means. 

You acknowledge and agree that your consent to electronic communications is being provided in connection with transactions affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act ("ESIGN"), and that you and we both intend that ESIGN applies to our relationship to the fullest extent possible to validate our ability to conduct business with each other by electronic means. 

2. Types of Electronic Communications You Will Receive: 

You understand and agree that we may provide documents and communications to you in electronic format only, via electronic means, including but not limited to sending links to documents or sending you documents via electronic mail for electronic execution.  These documents and communications can include but are not limited to: agreements, disclosures, notices, marketing, and other documents, information, and communications regarding your account(s), services and products, the use of our websites or our other electronic services, your relationship with us, and other programs, products or services that are or may be in the future made available to you (collectively, "Communications").  Such Communications may include, but are not limited to: 

  • This Electronic Communications Disclosure and any updates thereto;
  • Any agreements with FMI or its affiliates, as well as other service or user agreements for access to our websites or other electronic services, all updates to these agreements and all disclosures, notices and other communications regarding transactions you make through websites or our other electronic services;
  • Disclosures, documents, agreements, notices and other information related to your relationship with FMI, including but not limited to any notices required to be provided to you by law;
  • Periodic, annual, monthly or other statements, disclosures and notices relating to the maintenance or operation of an account, product or service, or other statements, disclosures or notices that may be required by applicable federal or state laws and regulations;
  • Any notice of the addition of new terms and conditions or the deletion or amendment of existing terms and conditions applicable to accounts, products or services you obtain from us;
  • Our online privacy notices and policies, our consumer privacy notice and other privacy statements or notices (by posting such notices on our website);
  • Certain tax statements or notices that we may be legally required to provide to you; and
  • Certain information or forms that we request from you and ask you to submit electronically, such as tax documentation, W-9 forms, or other agreements

3. Types of Communications You Will Receive in Paper Form: 

This Electronic Communications Disclosure does not apply to any communications that we determine, in our sole discretion, that we are required to deliver in paper form under applicable law or where we determine that you should receive in paper rather than electronic form.  Such communications shall be mailed to the primary physical mailing address we show for you in our records or otherwise delivered as required by law or the governing agreement. 

4. Hardware and Software Requirements

Supported Web Browsers -The Services are designed to function on modern, up to date browsers, including for example: Google Chrome, Microsoft Edge, Mozilla Firefox, Safari, or others. For the best experience, we recommend enabling JavaScript and cookies. 

Operating System Requirements - The Services generally support current and recent versions of: Windows, macOS, iOS, Android.  Legacy or unsupported operating systems may not display the Services correctly. 

Additional Software - Some features may require: a PDF viewer (e.g., Adobe Acrobat Reader); updated browser plugins or extensions, if applicable; and/or applications capable of viewing or downloading documents or media from the Services. 

Security Tools - You are responsible for maintaining appropriate security measures on your device, including antivirus and anti-malware protection; a secure, up to date browser; and firewalls or other protective tools. 

Disclaimer: We do not guarantee that the Services will function on all devices or software configurations. You are responsible for ensuring your system meets these requirements and is properly maintained. 

5. How to Withdraw Your Consent to Electronic Communications 

Subject to applicable law, you may withdraw your consent to receive electronic communications by contacting us as provided above.  If you elect to withdraw your consent to receive electronic communications, such election will be applied prospectively from the time of withdrawal; withdrawal of consent will not affect the legal effectiveness, validity, or enforceability of electronic records executed by, provided, or made available to You prior to withdrawing consent. You will not be charged a fee for withdrawal of your consent.  If you elect to receive required notices and disclosures only in paper format, it may slow the speed at which we can complete certain steps in transactions with you and deliver services to you.   

6. Obtaining Paper Copies 

You may print or make a copy of Communications by using the "Print" button (or otherwise using your printing functionality) to print Communications utilizing a printer, and you may also save an electronic copy on electronic storage media.  We recommend you save or print a copy of all Communications.   

Upon specific written request from you, we will provide you with a paper copy of any legally required Communications provided electronically by us to you.   

7. Updating Your Contact Information 

In the event that your contact information changes, you must notify us of such changes immediately.  For updates to your contact information, notify us as provided above. 

If you fail to update or change an incorrect or invalid electronic mail address or other contact information, you understand and agree that any Communications shall nevertheless be deemed to have been provided to you if they were made available to you through electronic means. 

8. Retain Copies for Your Records 

We recommend that you print or download a copy of this Consent to Receive Electronic Communications to retain your records. 

Minors 

FMI's Services are intended for use by those 18 years of age and older. FMI's Services are not intended for use by children. By using the Services, you agree that you are 18 years of age or older. We do not knowingly collect information from children without verifiable parental/guardian consent. If we determine the Services are being used by someone under the age of 18, we reserve the right to immediately terminate access.

FMI only engages in insurance business in the United States of America, and our Services are intended only for use within those jurisdictions in the United States of America where we are licensed to do insurance business. Our Services are not directed to nor intended for use in any other country or outside of any jurisdiction where we are not licensed. 

Your use of these Services is governed by the laws of the State of New Jersey, without giving effect to any conflict of law provision. Jurisdiction over any disputes shall be in the state court of Sussex County, New Jersey or the federal United States District Court for the District of New Jersey. 

Your Privacy 

Your privacy is important to you. FMI understands that. Our Privacy Notice applies to all individuals who apply for, obtain, or are covered by an insurance policy with us which is intended to be used primarily for personal, family or household purposes. The information in these Terms of Service does not amend, replace, contradict, or change the information about your rights regarding personal financial information in that Privacy Notice. 

You are responsible for keeping your username and password private. You may not share your username and password with anyone else. Make sure you pick a strong password—mix in numbers, capital letters, special characters, and avoid common words.  

You agree that FMI is authorized to comply with any instructions provided by your username and password. Any use of the Services that is done with your username and password is your responsibility, including any charges, even if you did not approve them. If you notice someone else using your account or anything else that seems suspicious, let us know right away. 

FMI is not responsible for any losses you experience because someone else used your username and password, whether you knew about it or not. However, you may be held responsible for any losses we or others suffer if someone else uses your username or password. 

Information We Collect and How We Use It 

When you use our Services, we may collect personal information about you in order to provide services and respond to requests from you. If you provide contact information to us through our Services, we may use that information to contact you with regard to your request and/or to suggest products or services that may interest you. We may also capture internet-related data such as cookies, pixels (or similar technologies), IP addresses, transaction history, and website browser and browsing information. We may disclose information we collect to respond to legal or regulatory requirements, protect against fraud, other unlawful activities, protect the safety of any individuals, or as permitted by law.  Pennsylvania: Any person who knowingly and with intent to defraud any insurance company or other person files an application for insurance or statement of claim containing any materially false information or conceals for the purpose of misleading, information concerning any fact material thereto commits a fraudulent insurance act, which is a crime and subjects such person to criminal and civil penalties. 

New Jersey: Any person who includes any false or misleading information on an application for an insurance policy is subject to criminal and civil penalties. 

Cookies and Internet Tracking 

Cookies, web beacons (pixels), local shared objects, tags and other tracking technologies may be used by us or third-party advertising and analytics companies to automatically collect information about your browsing activity for marketing feedback and targeted marketing.  These tracking technologies are small bits of data that are sent to your web browser from our server when you access our website.  The information we collect from tracking technologies is anonymous and does not include personally identifiable information, nor does it contain your name, address, telephone number, or email. 

“Cookies” are small blocks of data that are placed on your computer while you access our website. The cookies we use collect information that is not personally identifiable information to you.  It may include how you linked to our website. It also may include your IP address and information about your device, time of visit, and what pages you visit on our website.  We do this to provide services to you, enhance your online experience, and advertise our products and services. Cookies also assist our traffic measuring software which enables us to devote sufficient computer resources to our website. 

Web beacons or pixels are html code which allows us to gather information about visitors to our website or emails, such as content accessed and browsing patterns. 

We also use tools from third-party companies, such as Google Analytics. Social Media: FMI may have a presence on social media websites such as Facebook, Twitter, YouTube, LinkedIn, Instagram, or others. This social media presence is not for individuals to apply for or access service for an insurance policy. FMI's presence is not an endorsement of that social media host nor any products or services referenced there. FMI disclaims any responsibility for the postings of third-parties and does not guarantee or endorse any content posted by a third-party on our social media websites nor can we guarantee the accuracy. Clicking any links is at your own risk. 

You should not share or post any personal, financial, or confidential/sensitive information on third-party websites. You should not assume any information shared on such websites is confidential. 

How We Protect Your Information 

To protect the data integrity and security of your information, FMI uses administrative, technical and physical safeguards. We restrict access to information to only those with a need to know the information. Our employees are bound by confidentiality obligations as are the independent contractors we work with. 

New York Domestic Violence 

New York law provides protections for victims of domestic violence. If a New York resident provides us with a copy of your order of protection against the policyholder or other person covered by the policy, for the duration of the order, we will not disclose to the policyholder or other person the address and telephone number of you, or of any person or entity providing covered services to you. If a child is covered by an order of protection, then an adult may assert these rights on their behalf. Changes to These Terms 

FMI reserves the right to change this policy at any time. Your continued use of the Services following the posting of any changes indicates your acceptance of such changes. This current version replaces any prior versions that we may have been given to you. We encourage you to periodically review this policy to ensure you are familiar with the most current version. 

Miscellaneous 

If any portion of these Terms of Service are declared illegal, unenforceable, or ineffective in a legal forum, those provisions, terms, and clauses shall be deemed severable such that all other provisions, terms and clauses of this Agreement shall remain valid and binding.
