Your privacy is important to us at Franklin Mutual Insurance Group. Our goal is to earn and maintain your trust and confidence when handling information about you.

This notice explains how we - Franklin Mutual Insurance Group (including its members: Franklin Mutual Insurance Company, FMI Insurance Company, POM Insurance Company) along with our subsidiaries, officers, directors, and employees (collectively “FMI,” “we,” “our,” or “us”) - collect, use, and protect information about consumers (“you”). This includes details you share directly with us (like when you visit our websites), information provided by your agent or representative, and data we may receive from third parties, or through things like digital advertising campaigns.

Personal Information We Collect

We may collect nonpublic personal information about you and your household members to process your application, manage your insurance policy, and process any claims you submit. We may collect this information from a variety of sources, including:

  • Information you provide on your application or other forms (verbally, online, direct or via agent) such as name, address, date of birth, phone, email, Social Security number, date of birth, driver’s license number, lender information, prior claims, property information, online identifiers, or IP address.
  • Information from third parties such as consumer reporting agencies, (ex. motor vehicle reports, drivers reports, claim history, and credit information), insurance support organizations, photographs/videos, aerial imagery, appraisals, inspection reports, investigation reports, publicly available sources, and commercially available data aggregators.
    • If we use a consumer reporting agency, you may request to be interviewed in connection with the preparation of the investigative consumer report, and upon a request, you are entitled to receive a copy of the investigative consumer report.
  • Information you provide for billing or payment purposes, such as account numbers.
  • Information about your transactions with us, our affiliates or others, such as claim information, premiums, property information and medical information.

How We Use Personal Information

We use the personal information we collect to process your application, manage your insurance policy, and handle everyday business purposes include, for example: 

  • Market, sell and provide insurance: For example, calculating your premium, determining your eligibility for a quote/policy, confirming your identity, servicing your policy, billing, marketing third-party products/services for loss control, and processing payments.
  • Manage your claim: For example, processing your claim, conducting claims investigations, medical examinations, appraisals and/or inspections
  • Day-to-day business and insurance operations: For example, creating, maintaining, customizing, and securing accounts, supporting business functions, responding to requests, reporting and analyzing data, and improving products/services, detecting fraud, and defending our rights.
     

We may also de-identify and aggregate data as statistical information. Such information is not personal information as the identifying information has been removed. We may use and disclose this aggregated, or other de-identified, information to third parties without limitation.

Who We Share Personal Information With and Why

We do not sell your personal information. We may share your information to operate our business effectively and when required or permitted by law. This may include:

  • Providing service to you: For example processing an application, adjusting claims (adjusters, experts, investigators, consultants, and medical providers), maintaining your account(s), billing and payment processing.You cannot limit our sharing of information for these purposes.
  • Everyday business purposes of FMI: For example professional advice, insurance, reinsurance, or audit providers; support to FMI’s information technology; insurance support organizations; or others who provide support to FMI operations. We may also share anonymized information with persons or organizations that conduct scientific research, including actuarial or underwriting studies.
    • You cannot limit our sharing of information for these purposes.
  • Marketing purposes: For example for FMI products/services and those of our affiliates or non-affiliates. We may share your name, contact information, and basic policy information to offer our products and services to you. We may also disclose your information to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements. 
    • You can limit our sharing of your information to a non-affiliated third party. You cannot limit our sharing of information to an FMI affiliate. To limit how we share your information or for any questions, please send a written request to Franklin Mutual Insurance Group, Attention: Compliance Officer, P.O. Box 400, Branchville, NJ 07826.
  • To non-affiliated third parties as permitted by law or as authorized by you, such as processing or administering a financial transaction, preventing fraud, cooperating with law enforcement, responding to a subpoena, and complying with laws or regulatory requirements.
     

FMI may share your personal information to protect the life, health, security, or safety of any individual or in defense of any claim by you or dispute involving you and FMI. Your information may be disclosed in the event of an actual or potential business transaction involving FMI (such as a merger). We may also share your information with any parent/subsidiary company of FMI.

How We Protect Personal Information

We take the protection of your personal information seriously. We use a combination of administrative, technical, and physical safeguards to protect your data. We restrict access to nonpublic personal information about you to only those with a need to know the information to provide products or services to you.  These measures include computer safeguards and secured files and buildings. Additionally, our employees are bound by confidentiality obligations as are the independent contractors we work with.

How to Review Personal Information About You (New Jersey and South Carolina consumers ONLY)

Where required by law, you may have the right to review a copy of the personal information we have collected from/about you and request corrections if necessary. Where applicable, please make a written request to Franklin Mutual Insurance Group, Attention: Compliance Officer, P.O. Box 400, Branchville, NJ 07826 and provide your name, address, telephone number, policy number(s), and a description of what information you are looking for. We will respond within 30 days of your request. There may be a fee for a copy of your records. There are some kinds of information that we will not give you access to, such as that which is collected when we evaluate a claim under an insurance policy or when the possibility of a lawsuit, fraud or misrepresentation exists.

If, after reviewing the information in your file, you believe it is incorrect, please tell us. You have the right to request in writing that we correct, amend or delete recorded information that you feel is incorrect. Make a written statement to Franklin Mutual Insurance Group, Attention: Compliance Officer, P.O. Box 400, Branchville, NJ 07826 about what is inaccurate and why. We will re-investigate and provide a response to your request.
