Privacy Notice

This privacy notice applies to personal information the Franklin Mutual Insurance Group (including members the Franklin Mutual Insurance Company, FMI Insurance Company, POM Insurance Company) as well as any subsidiaries, officers, directors, and employees (“FMI”, “we”, “our”, or “us”) collects about consumers ("you"). This includes information provided by you directly, through your agent or other representative, as well as information collected from third parties. 

What Personal Information We Collect

Depending on your needs, we collect different types of information. This may include personal information about you and household members which may include:

Information you provide on your application or other forms such as name, address, phone, email, Social Security number, driver’s license number, lender information, prior claims, and property information.

Information from third parties such as consumer reporting agencies, (ex. motor vehicle reports, drivers reports, claim history, and credit information), insurance support organizations, photographs/videos, appraisals, inspection and investigation reports, publically available sources, and commercially available data aggregators.

If we use a consumer reporting agency, you may request to be interviewed in connection with the preparation of the investigative consumer report, and upon a request, you are entitled to receive a copy of the investigative consumer report.

Information you provide for billing or payment purposes, such as account numbers.

Information about your transactions with us, our affiliates or others, such as claim information, premiums, property information and medical information.

How We Use Personal Information

FMI uses your information for its everyday business purposes. This includes evaluating your application, verifying information you provide, adjusting claims, servicing your policy, billing and processing payments, marketing our products/services or those of third parties, and responding to your requests.  We also may use your information to detect fraud and defend our rights.

We may also de-identify and aggregate data as statistical information. Such information is not personal information as the identifying information has been removed. We may use and disclose this aggregated, or other de-identified, information to third parties without limitation.

Who and Why We Share Personal Information 

FMI may share your information as explained above and also as necessary to conduct business and as permitted or required by law.  This may include: 

  • Providing service to you - processing an application, adjusting claims (adjusters, experts, investigators, consultants, and medical providers), billing and payment processing. 
    You cannot limit our sharing of information for these purposes.
  • Everyday business purposes of FMI – professional advice, insurance, reinsurance, or audit providers; support to FMI’s information technology; insurance support organizations; or others who provide support to FMI operations.  We may also share anonymized information with persons or organizations that conduct scientific research, including actuarial or underwriting studies.
    You cannot limit our sharing of information for these purposes.
  • Marketing purposes - for FMI products/services and those of our affiliates or non-affiliates. We may share your name, contact information, and basic policy information.
    You can limit our sharing of your information to a non-affiliate.  You cannot limit our sharing of information to an FMI affiliate.   • To nonaffiliated third parties as permitted by law or as authorized by you, such as processing or administering a financial transaction, preventing fraud, cooperating with law enforcement, responding to a subpoena, and complying with laws or regulatory requirements.

FMI may share your personal information to protect the life, health, security, or safety of any individual or in defense of any claim by you or dispute involving you and FMI. Your information may be disclosed in the event of an actual or potential business transaction involving FMI (such as a merger).  We may also share your information with any parent/subsidiary company of FMI.

Reviewing Personal Information About You

You may review a copy of the personal information we have collected from/about you and request corrections if necessary. Please make a written request to privacy@fmiweb.com or to Franklin Mutual Insurance Group, Attention: Compliance Officer, P.O. Box 400, Branchville, NJ 07826 and provide your name, address, policy number(s), and a description of what information you are looking for. We will respond within 30 days of your request. There may be a fee for a copy of your records. There are some kinds of information that we will not give you access to, such as that which is collected when we evaluate a claim under an insurance policy or when the possibility of a lawsuit, fraud or misrepresentation exists.

If, after reviewing the information in your file, you believe it is incorrect, please tell us. You have the right to request in writing that we correct, amend or delete recorded information that you feel is incorrect. Make a written statement to privacy@fmiweb.com or to Franklin Mutual Insurance Group, Attention: Compliance Officer, P.O. Box 400, Branchville, NJ 07826 about what is inaccurate and why. We will reinvestigate and provide a response to your request.

How We Protect Your Personal Information

To protect the data integrity and security of your personal information, FMI uses administrative, technical and physical safeguards. We restrict access to information to only those with a need to know the information. Our employees are bound by confidentiality obligations as are the independent contractors we work with.
